Military pensions to be paid without restrictions — Rada prepares amendments to law

The Rada will consider abolishing coefficients that reduce military pensions.

The Verkhovna Rada has registered bill No. 15090, which proposes to prohibit the application of reducing coefficients to military pensions. As reported by the PromPolitInform portal, Sudovo-Yurydychna Gazeta writes about this.

The bill proposes to amend Article 43 of the Law of Ukraine “On Pension Provision for Persons Discharged from Military Service and Certain Other Persons” and prohibit the application of reducing coefficients when calculating and recalculating pensions for military personnel and members of their families.

Where did the reducing coefficients come from

According to Part Five of Article 17 of the Constitution of Ukraine, the state is obliged to ensure social protection of military personnel and members of their families.

The issue of pension provision for this category of citizens is regulated by the Law of Ukraine “On Pension Provision for Persons Discharged from Military Service and Certain Other Persons”, which guarantees a decent level of pensions, their recalculation in the event of an increase in cash benefits, and other social payments.

At the same time, Article 46 of the Law of Ukraine “On the State Budget of Ukraine for 2025” provides that in 2025, during martial law, pensions assigned under the Law of Ukraine “On Pension Provision for Persons Discharged from Military Service and Certain Other Persons”, if their amount exceeds ten subsistence minimums for disabled persons, shall be paid with the application of reducing coefficients to the amount of the excess.

This was noted by the Supreme Court, which in its resolution of September 11, 2025 in case No. 120/1081/25 noted that the norms of the Law of Ukraine “On the State Budget of Ukraine for 2025” and the corresponding government resolution introduced a temporary restriction of pensions through reducing coefficients. In fact, this created additional regulation that differs from the norms of the Law of Ukraine “On Pension Provision for Persons Discharged from Military Service and Certain Other Persons”.

As a result, as the authors of the draft law note, the application of such coefficients narrows the right of military personnel to proper social protection guaranteed by the Constitution of Ukraine and a special law. In addition, they believe that the Law of Ukraine “On the State Budget of Ukraine for 2025” should not change or restrict the rights established by other laws, and its application in this part may contradict Articles 8, 19 and 92 of the Constitution of Ukraine.

Additionally, the authors of the draft law refer to the position of the Constitutional Court of Ukraine. The Decision of August 28, 2020 No. 10-р/2020 states that the subject of the Law on the State Budget of Ukraine is determined by the Constitution of Ukraine, therefore this law cannot cancel or change the scope of rights, privileges and guarantees established by other laws. Also, the Decision of July 9, 2007 No. 6-рп/2007 emphasized that the budget law cannot change the content of other laws.

In addition, the Decision of the Constitutional Court of Ukraine of February 27, 2020 No. 3-р/2020 states that the Budget Code of Ukraine and the laws on the state budget cannot amend other laws, suspend their effect or establish other legal regulation than that provided for by special laws.

Therefore, the authors of the bill consider it appropriate to establish at the legislative level a ban on the application of reducing coefficients to pensions of persons discharged from military service.
