Unauthorized access to military facilities could lead to fines up to 51,000 UAH

The government approved a Ministry of Defence initiative introducing a new article into the Administrative Code

The Cabinet of Ministers of Ukraine has supported a draft law on administrative liability for unauthorized entry into military facilities. Penalties ranging from 8,500 to 51,000 UAH are proposed for such violations. This is reported by the portal PromPolitInform, citing information from the Ministry of Defence of Ukraine.

The proposed changes aim to update the Code of Ukraine on Administrative Offences by adding Article 186⁹. According to the document, the basic fine will range from 500 to 1000 tax-free minimum incomes, which is equivalent to between 8,500 and 17,000 UAH. Law enforcement officers would be authorized to confiscate tools used to gain illegal access to these facilities.

Sanctions for repeat offences and special periods

The document mandates stricter penalties for individuals who repeat such offences within a single year. For repeat offenders, the fine will increase to 2,000 tax-free minimum incomes, or 34,000 UAH. The maximum penalty of up to 51,000 UAH will apply to unauthorized access occurring during a special period.

Under the draft law, a special period refers to the time when the national economy and security agencies operate from the moment of mobilization or the declaration of martial law. The definition of military objects includes areas with structures and storage grounds for military equipment and ammunition, as well as specific vehicles and premises belonging to the Armed Forces of Ukraine or the Ministry of Defence.

Requirements for marking and security

The legislative initiative clarifies that only objects equipped with proper fencing or signage will be considered protected. Another mandatory requirement is that the area must be under the guard of military personnel, paramilitary units, or security guards.

Administrative cases involving these violations will be adjudicated by local or municipal courts. The authors of the bill emphasize that these measures are intended to improve public safety and protect sensitive information regarding military infrastructure locations. The draft law has already been registered in the Verkhovna Rada; it requires parliamentary approval and the signature of the President of Ukraine to come into force.
