The Cabinet of Ministers plan covers three stages of state-owned enterprise transformation
The Cabinet of Ministers of Ukraine has approved a Roadmap for the phased abolition and revision of restrictions on the enforcement of court judgments and bankruptcy procedures for state-owned enterprises. The document envisages a gradual phase-out of dozens of long-standing moratoria that have complicated the protection of creditors' rights. The initiative aims to solve the problem of non-enforcement of court decisions and improve the investment climate while maintaining control over strategic assets. This is reported by the portal PromPolitInform, citing information from the Cabinet of Ministers of Ukraine, based on data from the Ministry of Justice of Ukraine.
The issue of non-enforcement of court decisions regarding the public sector has long remained one of the most acute problems of the country’s legal system. The European Court of Human Rights had previously drawn attention to its systemic nature, notably in the well-known cases of Yuriy Nikolayevich Ivanov v. Ukraine and Burmych and Others v. Ukraine. The Committee of Ministers of the Council of Europe has also repeatedly demanded that the Ukrainian authorities eliminate the root causes of this state of affairs through deep legislative reforms.
Current Restrictions and Scope of the Problem
An analysis conducted by the relevant agency revealed the existence of more than two dozen legislative acts introducing two and a half dozen corresponding moratoria. Of the total number of restrictions, nearly eighteen block the enforcement of debt collection, while eleven prohibit the initiation of bankruptcy procedures. Some of these protective mechanisms have been functioning for decades, undermining payment discipline and reducing the attractiveness of the national economy for capital investments.
Document Development and International Support
The process of creating the strategic plan was carried out jointly by the Ministry of Justice and other executive power institutions with the active involvement of foreign partners. Significant assistance was provided by experts from the European Bank for Reconstruction and Development, who performed a detailed assessment of the impact of current bans on creditors and economic activity in general. The document approved by the government is designed to form a balanced model that will guarantee the enforcement of court verdicts without causing harm to state security.
Stages of Government Plan Implementation
The planned measures will be based on a differentiated approach to business entities depending on their economic significance and financial performance. The first stage is designed for the period up to 2030 and concerns public sector enterprises that do not play a critical role in defense and general security. The second stage will begin after the termination of martial law and will cover strategically important objects, for the protection of which they plan to introduce alternative legal instruments such as special administration or the right of operational management.
