The Pension Fund will independently verify document ownership in cases of data discrepancies
The Cabinet of Ministers of Ukraine has adopted a resolution allowing pensioners to confirm their work experience without a labour record book or in cases where it contains inaccuracies. These new rules aim to reduce court cases and streamline the pension application process. This is reported by the portal PromPolitInform, citing information from the Ministry of Social Policy of Ukraine.
These changes are designed for citizens who are unable to provide a full set of documents due to military actions, territorial occupation, or enterprise liquidation. To address this issue, the list of sources from which the Pension Fund of Ukraine can draw data for pension eligibility has been expanded.
Evidence may now include extracts from personnel orders, payroll records, and bank statements confirming payments. The list also includes court rulings establishing employment status and tax authority data regarding unified tax payments or received income.
Confirming Experience via Witnesses
In instances where archives have been destroyed or documentary evidence is unavailable, the procedure will involve witnesses. Testimony from at least two individuals who worked at the same company during the same period as the applicant is required.
The Pension Fund of Ukraine has been tasked with assisting citizens in locating such witnesses using data from the Register of Insured Persons. This measure is intended to eliminate the need for litigation in matters that previously required court intervention.
Procedures Under Martial Law
The updated rules allow for the recognition of work experience even if labour record books contain corrections, provided the enterprise was located in a combat zone or temporarily occupied territory. Procedures for these cases will be subject to additional coordination with the Ministry of Social Policy of Ukraine.
The requirement for mandatory court appeals in cases of personal data discrepancies has also been lifted. If a document regarding work experience contains a different name, surname, patronymic, or date of birth compared to a passport or birth certificate, the Pension Fund will independently verify the document’s link to the specific individual based on a specially established procedure.
