Naftogaz has been granted the right to recover $1.4 billion from Gazprom through a Kazakh court

The court of the Astana International Financial Center has allowed the forced recovery of about $1.4 billion from Russian Gazprom in favor of NJSC Naftogaz of Ukraine. This is reported by Delo.ua with reference to the company’s press service. The PromPolitInform portal informs.

Naftogaz has won an important victory

This is the first public foreign court decision on the recognition and granting of permission for the forced execution of this arbitration award against Gazprom on the territory of a separate state.

Serhiy Koretsky, Chairman of the Board of NJSC Naftogaz of Ukraine, stated that the court’s decision in Kazakhstan was another practical step in the process of recovering funds from Gazprom. According to him, the company continues to work on the implementation of the arbitration award in various jurisdictions and is consistently moving in this direction.

The interests of Naftogaz during the consideration of the case in Kazakhstan were represented by the law firms ADL Disputes and Wikborg Rein.

The essence of the case

Recall that in March 2026, the Naftogaz of Ukraine Group finally won an arbitration dispute against Gazprom for more than $1.4 billion. Then the Federal Supreme Court of Switzerland rejected the Russian company’s complaint and upheld the arbitration award made in June 2025.

According to the court decision, Gazprom is obliged to pay Naftogaz the debt for gas transportation services, as well as interest and legal costs. In addition, the Russian company must pay 200 thousand Swiss francs in legal costs and compensate Naftogaz for another 250 thousand francs in costs of proceedings in the Federal Supreme Court of Switzerland.

The basis for the dispute was the 2019 agreement on the transit of natural gas through the territory of Ukraine, which was valid until January 1, 2025. After the start of a full-scale war and the occupation of part of the territories in May 2022, transit through the Sokhranivka entry point became impossible. At the same time, Naftogaz continued to provide transit through the Sudzha station, but Gazprom, according to the Ukrainian side, refused to pay for the services in full, violating the terms of the contract.

In September 2022, Naftogaz initiated arbitration in Switzerland in accordance with the rules of the International Chamber of Commerce (ICC). In June 2025, the arbitration tribunal found Gazprom fully liable for non-fulfillment of financial obligations and ordered the company to recover the debt, interest and arbitration costs.

Naftogaz also stated that it was continuing to work on the forced recovery of funds from the Russian company in various jurisdictions, while simultaneously conducting other legal proceedings against the Russian Federation to compensate for losses.
