The court made an important decision on the payment of pensions to Ukrainians in installments

Paying pensions in installments is illegal. Even if it is about returning a pension owed. The state must return the debt to people in full at once.

This conclusion was reached by the Kyiv District Administrative Court, after considering the claim of one of the pensioners. Thus, Themis declared illegal the government resolution No. 821, which allows pensioners to pay arrears in installments. This was reported by lawyer Tetyana Golytsya on the YouTube channel “Law Office of Ivan Khomych”, who defended the interests of the plaintiff. The PromPolitInform portal reports.

Many Ukrainians have already sued the state for their underpaid pensions. At the same time, they are obliged to return the debt. Before the publication of resolution No. 821, the entire debt was returned to them in one lump sum. However, after the Cabinet of Ministers adopted this resolution, the debt began to be returned to citizens in parts. Moreover, not regularly, but only if there are free funds. And now the court has recognized this method of repaying the debt, as well as the government resolution itself, as illegal.

The court decision was made on March 4, 2026. According to the law, the Cabinet of Ministers of Ukraine, the Pension Fund or the Ministry of Social Policy had 30 days to appeal this decision. Otherwise, it was supposed to come into force on April 3. There is no information in the messages from the PFU about filing an appeal against this court decision. Probably, the government or the Ministry of Social Policy, or no one, could have done this.

In this case, all pensioners who have sued the state for part of the unpaid pension have the legal right to demand payment of the debt not in parts, but immediately and in full.
