The Cabinet of Ministers is preparing new fines for wastewater and violations of drainage regulations

The Cabinet of Ministers proposes introducing new fines in connection with the adoption of the Law “On Drainage and Wastewater Treatment.”

The Cabinet of Ministers has approved a draft law amending the Code of Ukraine on Administrative Offenses in light of the adoption of the Law “On Drainage and Wastewater Treatment.” This was reported by the «Sudovo-Yurydychna Hazeta» (Judicial-Legal Newspaper) and cited by the PromPolitInform portal.

The bill proposes amending Articles 61 and 221 of the Code of Ukraine on Administrative Offenses regarding the determination of fine amounts to be imposed on citizens and officials.

Grounds for fines

The proposed changes regarding fines will cover liability for:

damage to hydraulic structures and devices;

damage to centralized drainage facilities and systems;

violation of their operating rules;

violation of established operating regimes for artificial water bodies, water management systems, and centralized drainage systems.

Additionally, it is proposed to add a new Article 82-9, “Violation of primary accounting rules in the drainage sector,” to the Code of Ukraine on Administrative Offenses.

It will establish liability for violations of accounting rules regarding:

wastewater entering centralized drainage systems; volumes of sewage sludge generation and treatment;

storage and reuse of sewage sludge.

In addition, the government proposes introducing Article 154-1, “Violation of legislation in the field of wastewater disposal.” It will establish administrative liability for violations of legal requirements in this area, as well as the corresponding fines.
