The issue of paying pensions in the amount listed by court decisions and paying previously created debts still remains relevant. Even court decisions are not able to move the problem from its place. Executive bodies react somewhat sluggishly, and often completely ignore legislative initiatives. This forces pensioners to turn to court again. And – everything in a circle.
What are the root causes of the problem and how they can be solved, says the Head of the All-Ukrainian public organization “Union of Officers of Ukraine” Oleksandr Sasko. He expressed his vision to the PromPolitInform portal.
“Only Mr. Ulyutin and Mr. and Mrs. Prime Minister did not know that Resolution 821 of the CMU was illegal. Even Mr. Shambir and Mrs. Valentyna Kudin knew about it. Why Ms. Lyudmila Sugak did not know about it (or did she know) is a question, because, probably, the notorious Minister of Justice Galushchenko endorsed this resolution during Mr. Shmyhal’s era,” Sasko notes.
Thus, on June 8, the Sixth Administrative Court of Appeal confirmed the illegality and invalidity of the resolution of the Cabinet of Ministers of Ukraine dated 14.07.2025 No. 821 “On Approval of the Procedure for Expenditures from the Budget of the Pension Fund of Ukraine for the Payment of Pensions (Monthly Lifetime Cash Allowance to Retired Judges) Assigned (Transferred) to Execute Court Decisions.” The court obliged the Cabinet of Ministers of Ukraine, after the decision entered into legal force, to immediately publish the operative part of the court decision on the recognition of the regulatory legal act as unlawful and invalid in the publication in which it was officially published (and that’s it?).
The court did NOT oblige the head of the Main Directorate of the State Financial Administration of Ukraine in Kyiv (for example) to remove the resolution from his desk. And it did not oblige the Cabinet of Ministers to cancel the resolution and pay everything that is due and as it should be…
However, these court decisions once again opened the way to the court for pensioners to pay pensions in the amount calculated according to court decisions and to pay previously created debts. And no spiral of development – everything goes in a circle.
The government is in a zugzwang and therefore resort to outright deception – a bill has been developed that does not solve the problem, but drives it into an even more blind corner. The root causes have not been eliminated.
But, Oleksandr Sasko believes, there is a way out. It is necessary:
First. To finally cancel the resolution of the Cabinet of Ministers of Ukraine from 2018 No. 103.
Second. To restore the resolution of 2008 No. 45 to its original form.
Third. To recalculate previously assigned and paid pensions to all pensioners in accordance with the legislation and … More to come.
