Enforcement of the court decision has been postponed for one year until September 9, 2027
The Commercial Court of Kyiv City has ruled to collect more than 234.6 million UAH in debt from DTEK Zakhidenergo in favor of Ukrenergo. The enforcement of the court order has been deferred for 12 months. This was reported by Economichna Pravda, according to the portal PromPolitInform.
The financial claims of the transmission system operator are based on the non-payment for dispatch management services provided in the fourth quarter of 2024. The total amount of the principal debt for this period stands at 233.05 million UAH.
Shortage of Working Capital
During the proceedings, representatives of DTEK Zakhidenergo requested a deferral, citing a critical lack of financial resources. The company’s difficult situation is caused by the need to fund restoration work at facilities damaged by Russian strikes on energy infrastructure.
The company stated that paying the debt in full would negatively impact its ability to meet tax obligations and continue production activities. Furthermore, company representatives highlighted significant debts owed by Ukrenergo itself.
Mutual Financial Demands
According to the argument from the private energy firm, the state company owes it more than 4.33 billion UAH, which is currently the subject of ongoing litigation. DTEK Zakhidenergo hopes to settle these counter-obligations following the conclusion of court cases, expected by mid-2027.
The court considered the arguments of both parties, ordering the collection of the principal debt, as well as 579,000 UAH in three-percent annual interest and 999,000 UAH in inflation-related losses. The deadline for executing this decision has been pushed to September 9, 2027.
