The government has instructed authorities to review enterprise criticality criteria
The Cabinet of Ministers of Ukraine adopted Resolution No. 1328 dated October 23, 2026, introducing changes to the procedure for reserving liable-for-military-service individuals during mobilization and martial law. Central and local executive authorities were mandated to review and harmonize the criteria for designating enterprises as critical to the economy within ten days. This is reported by the portal PromPolitInform, citing information from the Cabinet of Ministers of Ukraine.
The government decision provides for amendments to previous resolutions of the Cabinet of Ministers of Ukraine No. 76 dated January 27, 2023, and No. 707 dated June 18, 2024. The changes concern the implementation mechanisms of the law on mobilization preparation and draft organization.
According to the document, ministries, other state bodies, as well as regional, Kyiv and Sevastopol city state administrations must review their own criteria for the importance of enterprises for the functioning of the economy and meeting the needs of the Armed Forces within a ten-day period.
Analysis of Enterprise Compliance
In addition to reviewing the regulatory framework, authorized bodies are required to conduct a detailed analysis of the compliance of operating enterprises, institutions, and organizations with the updated requirements.
If a criterion that served as the basis for granting an enterprise critical status is excluded, the respective decision is subject to cancellation.
Validity of Previous Decisions
At the same time, it is established that decisions on designating enterprises as critical that are in force on the date the new resolution enters into force shall retain their validity for the entire term for which they were adopted, except for cases of cancellation due to non-compliance with updated criteria.
The status of decisions made by the Minister of Defence regarding the expansion of conscript reservation volumes adopted prior to the entry into force of previous amendments on December 8, 2025, has also been separately regulated.
