Health Benefits for Military Personnel: Who Can Receive the Full Amount and When

When does the right to an annual payment equal to a monthly allowance arise, and under what conditions can it be provided without actually going on leave

Military personnel are entitled to receive a monthly allowance for health benefits once a year. The Zaporizhzhia Regional Center for Health and Social Development and the Service of the Armed Forces of Ukraine explained when exactly this right arises and under what conditions the funds are paid. This was reported by the Judicial and Legal Newspaper, as reported by the PromPolitInform portal.

According to the Procedure for Payment of Allowances to Military Personnel of the Armed Forces of Ukraine and Certain Other Persons, approved by order of the Ministry of Defense of Ukraine:

Military personnel who have acquired (or are acquiring) the right to receive annual basic (vacation) leave are paid a monthly allowance for health benefits once a year.

According to the Law of Ukraine “On the Social and Legal Protection of Military Personnel and Their Families”:

For military personnel, the duration of annual basic leave in the year of commencement of military service is calculated at a rate of 1/12 of the leave duration […], for each full month of service until the end of the calendar year.

Thus, military personnel acquire the right to leave and health assistance immediately after their first full month of service.

The TCC emphasizes that the law stipulates that annual basic leave is granted provided that no more than 30 percent of the total number of military personnel of a certain category in the relevant unit is absent at any one time. In addition, there may be other objective reasons for denial of leave, such as a pre-arranged vacation schedule.

We also note that financial assistance for health assistance is provided to military personnel:

in the event of their departure on full annual basic leave or the second part of their annual basic leave, including in permitted cases for unused vacation from previous years;

without going on leave (based on their report during the current year) based on an order from the military unit commander, and for the commander (chief) – based on an order from the senior commander (chief) indicating the amount of financial assistance.
