The Federal Supreme Court of Switzerland completely rejected the complaint of Russian Gazprom and upheld the decision of international arbitration of June 2025. This means that Gazprom is obliged to pay Naftogaz more than $1.4 billion in debt for gas transportation services, as well as interest and legal costs.
This was announced by the Chairman of the Board of Naftogaz Sergey Koretsky, informs the portal PromPolitInform.
According to him, the company is already working on compulsory debt collection from Russians. He added that in parallel there are a number of other trials against the aggressor country to compensate for losses.
Under the 2019 agreement, Naftogaz pledged to organize the transit of natural gas through Ukraine for Gazprom until January 1, 2025. In May 2022, due to the actions of the Russian invaders, transit through the Sokhranovka point became impossible, but Naftogaz continued to provide services through the Suja point. At the same time, Gazprom refused to pay the full amount, violating its contractual obligations.
In September 2022, Naftogaz initiated arbitration proceedings in Switzerland under the Rules of the International Chamber of Commerce (ICC). In June 2025, the company received the Final Arbitration Award in Zurich and sent Gazprom a payment claim of $1.37 billion, which includes principal, penalties and compensation for legal expenses.
Koretsky noted that since May 2022, Gazprom has violated the take or pay principle (take or pay) and stopped paying for transit. In parallel, Naftogaz continues to enforce another arbitration decision on the payment of $5 billion to the Russian Federation for the illegal expropriation of assets in Crimea in 2014.
