A general mobilization is underway in Ukraine, within the framework of which men liable for military service are subject to conscription. At the same time, certain categories of workers can receive a reservation, which allows them to temporarily avoid conscription. As Prozoro.net.ua writes, military lawyer Mykhailo Lobunko explained in a comment to one of the publications in which cases such a reservation can be canceled early. This is reported by the PromPolitInform portal.
When can a reservation be canceled
According to the specialist, there is a clearly defined list of reasons under which an employee can lose a reservation before the established deadline. It is exhaustive and provided for by current legislation.
“Early cancellation of a reservation is possible only for the reasons listed in paragraph 31 of Procedure No. 76”.
Among the main reasons is the loss of the status of a critical enterprise by the enterprise, which is confirmed by the decision of the relevant body. The reservation can also be canceled in the event of the dismissal of an employee, except in cases of internal transfer.
In addition, the employer has the right to initiate the cancellation of the reservation through the “Diya” service, but not more often than once every five calendar days and only if there are justified grounds. Other reasons include the liquidation of the enterprise, violation of the reservation conditions, in particular exceeding the established quotas, as well as other grounds specified by law.
Do personnel changes affect
The lawyer emphasized that changes within the company in themselves are not grounds for losing the reservation. In particular, the transfer of an employee to another position or to another unit within the same enterprise does not lead to the cancellation of this status.
“The reservation remains valid automatically. The enterprise is only obliged to notify the CCC of the change of position/unit within 3 days. After that, the data is updated in Reserve+, and the reservation status is saved,” the expert noted.
