The government is considering options ranging from a total ban on the realtor profession to mandatory certification
The Ukrainian government and the Verkhovna Rada are considering three different approaches to the activities of realtors, including the possibility of a total ban on brokerage services. Relevant initiatives are outlined in two petitions to the Cabinet of Ministers and one draft law. This was reported by Glavcom, according to the portal PromPolitInform.
Government officials and Members of Parliament are studying three paths to reforming the real estate sector: from the radical liquidation of the intermediary profession to comprehensive legislative regulation and professional certification. The discussion centers around petitions No. 10590 and No. 11148, as well as draft law No. 16145, which has been registered in parliament.
Initiatives to Ban Brokerage
Petition No. 10590 calls for a complete ban on the activities of real estate agencies and private realtors. The authors of the appeal argue that this is necessary due to the existence of shadow schemes, tax evasion, and the imposition of services, which increases the financial burden on buyers and tenants.
Proponents of this initiative also point to the lack of legal guarantees for the parties to a transaction. In their view, eliminating intermediaries will ensure direct communication between property owners and tenants or buyers.
Protecting Professionals’ Rights and Market Regulation
In contrast, the authors of petition No. 11148 oppose equating the entire profession with unscrupulous market participants. They emphasize the importance of services provided by realtors: document verification, property advertising, negotiation support, and property viewing organization.
This position does not involve setting a single state tariff, leaving the issue of payment to the discretion of the parties. At the same time, the authors propose introducing clear rules of cooperation and establishing liability for breaches of agreements.
Draft Law No. 16145 on Agent Qualification
The third approach, contained in draft law No. 16145, focuses on the introduction of professional accreditation. The document provides for the definition of the rights and duties of market participants, the establishment of qualification requirements, and the development of professional self-governance.
The main goal of these changes is to minimize fraud during real estate transactions and gradually bring the market out of the shadows. The authorities aim to increase the transparency of the industry by filtering out casual participants who lack the necessary professional training.
